Assistance program for mortgage borrowers this year. Who is eligible for government mortgage assistance? Who can count on support

The state program for assistance to borrowers, implemented by the Housing Mortgage Lending Agency (AHML), was introduced in 2015. The need for such support was dictated by the high debt burden of the population and a significant increase in the exchange rate of foreign currency. Government support was primarily intended for people in difficult financial situations.

Over the several years of existence of such a project, its high efficiency and demand, but the program was suspended due to a lack of budget funds. As a result, citizens began to receive massive refusals to restructure their loans. In August 2017, the government decided to extend the subsidy, but some changes were made to the program.

In 2018, mortgage borrowers will be able to take advantage of government assistance under new rules. The government promises citizens to reduce their mortgage debt if certain requirements are met. The innovations mainly affected foreign currency loans.

The main essence of the state housing lending program

In order to take advantage of government assistance in restructuring a mortgage loan, the borrower will have to collect a special package of documents and write an application to his bank. If the citizen receives approval, an additional agreement to the current contract will be concluded with the borrower. After debt restructuring, the cost of monthly payments is reduced to 11.5% per annum, and the debtor receives a preferential deferment of up to one and a half years.

State subsidies aimed at reducing the principal debt on a mortgage loan are allocated from the federal budget. To control financing, the Housing Mortgage Lending Agency was created, which began to play the role of an intermediary between the lender and the borrower. As a result of such a scheme, the bank receives lost financial benefits, and the borrower receives preferential lending conditions.

In order to understand how the largest government business project works, you need to study the cash flow mechanism of this organization. AHML has a two-tier financing system. At the first stage, the agency works closely with creditors who issue and restructure complex debt under the AHML program. At the second stage, the organization buys the rights of claim on such loans and, using their security, raises funds on the stock market by issuing highly liquid valuable papers.

All participants in this scheme benefit financially. The bank charges a fee for servicing the client and does not think about where to get funds for lending. The borrower pays off the mortgage at a lower interest rate. AHML does not check an individual’s solvency, since it issues money to the bank, and in case of non-repayment of the debt, all issues are resolved without his participation.

The extension of the state subsidization program for mortgage loans in 2018 was made possible thanks to an additional issue of securities in the amount of 2 billion rubles.

Restructuring a mortgage loan under the AHML program

AHML assistance to mortgage borrowers who find themselves in a difficult financial situation in 2018 will be carried out on the basis of Resolution No. 961 of 08/11/17. Under the new program, individuals can receive financial support in the form of writing off 30% of the remaining debt, but not more than 1.5 million rubles. In addition, the borrower can count on the cancellation of the accrued penalty, which was not written off by decision of the judicial authorities.

After the home mortgage is refinanced, the cost of a foreign currency loan will be 11.5% per annum, and a ruble loan will not be higher than the current bank rate. The state can provide two types of assistance during debt restructuring:

  • conversion of a foreign currency loan into a ruble loan at a reduced rate;
  • writing off as much of the debt as possible.

Mortgage loan restructuring is carried out only by decision of the lender. When assigning the right of claim, no commission is charged. AHML handles the on-lending process. Under Resolution No. 961, the following categories of citizens can count on preferential borrowing:

  • families with minor children;
  • combat veterans;
  • guardians and trustees raising young children;
  • citizens with a disability group;
  • individuals whose dependents are persons under 24 years of age.

An additional condition has also been established for all of the above persons. Their average monthly income for the last three months before restructuring should be less than two living wages for each family member. The minimum wage is determined in accordance with the region of residence of an individual. In addition, the second condition will be an increase in the monthly payment by 30% compared to the date of receipt of the mortgage. This clause makes the preferential refinancing program unavailable for most ruble borrowers.

At the end of 2017, to resolve the issues of clients who were not included in the state subsidy program, a special commission was created, which reviewed applications individually individuals, which, despite the obvious need, do not meet the established conditions. A list of such people in need is compiled by the bank based on the personal application of the borrower. The interdepartmental commission may decide to increase maximum size subsidies are doubled for certain groups of people in need.

There is an opinion that banks deliberately refuse citizens to refinance a loan, but this is not true, since such a procedure is beneficial for financial institution. When assigning the right of claim, the financial loss that may arise from early repayment of the loan will be compensated by the state.

The mortgaged property must also meet certain requirements. In order to receive preferential lending, the collateral area must meet the following requirements:

  • a one-room apartment should not be more than 45 square meters. m, two-room – 65 sq. m, three-room apartment over 85 sq. m;
  • the cost of one square meter should be no more than 60% of the established price in the region;
  • the purchased housing must be the citizen’s only one, while shared ownership of property in another premises is allowed, but not more than 50% for the whole family.

It is worth noting that the requirement for the area and cost of a meter of real estate does not apply to large families. If this category of citizens has other property, then it can be quickly transferred to other relatives, and then the right to preferential lending with state support will not be lost.

What documents will be required for loan restructuring in 2018

In order to refinance a mortgage loan under the state program, you need to provide your bank with an application, documents confirming the identity of the borrower, his right to preferential lending and mortgage real estate. The bank is also provided with various certificates about the status of the existing loan and payments made. Depending on the terms of the loan, the list of documents may include additional forms, as well as some certificates from general list may be optional.

A sample list of documents looks like this:

  • application form for revision of the current terms of a mortgage loan under the state subsidy program with a mandatory indication of the reason;
  • ID cards of all family members (passports, birth certificates);
  • in case of a change of surname, the borrower provides a certificate of divorce or marriage;
  • guardians will need an extract from the court decision confirming their status;
  • veteran's certificate;
  • a document confirming the disability group of the applicant or his children;
  • an extract from a financial and personal account with information about cohabitation persons under the age of 24;
  • a certificate from a school or university stating that the child is studying full-time;
  • copy work book for a working citizen with a note that the borrower is currently employed;
  • for individual entrepreneurs, a certificate of registration or an extract from the Unified State Register of Entrepreneurs;
  • original work book for the unemployed;
  • certificate of receipt of unemployment benefits for those registered at the labor exchange;
  • income certificate in form 2-NDFL from all working family members;
  • tax return, patent;
  • for a pensioner - a certificate of the amount of pension for the last 12 months, for a student - a document confirming the amount of the scholarship;
  • current loan agreement and monthly mortgage payment schedule.

The following documents are provided for the pledge:

  • property document (certificate);
  • mortgage (if any);
  • a statement from the borrower about the presence of other property;
  • agreement of share participation in a new building under construction;
  • collateral assessment album;
  • technical and cadastral passport of the premises.

After all the documents have been prepared, the package must be sent to the bank, in turn, the lender will submit the documentation for verification to AHML. In accordance with the regulations, consideration of the application should take no longer than 30 days. If it is necessary to provide additional information about the borrower, the procedure may take several months.

With the fall in the ruble exchange rate economic situation has worsened in the country. Many families who took advantage of mortgage programs began to experience difficulties in repaying their debt. To help borrowers, the Government signed a Decree regulating the scheme and methods for implementing loan restructuring. Read the article for details about the mortgage borrower assistance program.

Who will the government help pay off their mortgage debt?

The government is ready to help borrowers who are citizens of the Russian Federation subject to certain conditions:

  • the client documents a decrease in family income of more than 30%;
  • the income per family man after taking into account the mortgage contribution is less than one and a half subsistence minimums;
  • there is no information that the person has been declared bankrupt in court.
  • the family is a participant in a federal or municipal program to optimize housing conditions and has taken out a preferential mortgage;
  • there are one or more minor children in the family;
  • the borrower is a combat veteran, disabled or has a disabled child;
  • the client is a government employee with at least 1 year of experience.

Options for government support for borrowers

There are several alternative options assistance to insolvent debtors.

  1. The loan currency is converted into national currency at the current exchange rate.
  2. The rate on a foreign currency loan is set no higher than 12% per annum. The rate on a ruble loan is fixed until the end of the lending period.
  3. The current payment is reduced to 50% for up to one and a half years. In this case, the underpaid amount is carried forward to subsequent periods.
  4. The client’s financial obligations are reduced by 10% of the debt balance, but not more than RUB 600,000.
  5. The bank does not charge the client any fees for restructuring.

The choice of restructuring option depends on the specific terms of the agreement: the currency of the loan, its validity period, etc. The lender is not obliged to write off fines and penalties accrued to the client for late payment, but may do so at his own discretion.

Government Resolution 373

On April 20, 2015, Government Resolution No. 373 became valid. According to this document, certain categories of borrowers received the right to loans in national or foreign currency. This includes the following cases:

  • family income decreased by more than 30%;
  • Due to the depreciation of the ruble, loan payments in foreign currency increased by more than 30%.

Restructuring in this case involves the following adjustments to the terms of the contract:

  • reduction of the current contribution for a period of no more than 1 year;
  • partial write-off of the debt body;
  • change in the loan rate – no higher than 12% per year.

When restructuring mortgage loans, creditor banks have the opportunity to return part of the lost profit within 6-12 months. For one loan, the permissible repayment limit is 10% of the loan balance, but not more than 600 thousand rubles.

In addition, the authorized capital of OJSC AHML was additionally financed by 4.5 billion rubles. This means that even more families will be able to count on assistance from the state.

Having learned about the extension of this program in early March, we called the hotline 8-800-7-5555-00, passed the compliance test successfully, and after telling the employees that we were eligible for this program, we began collecting documents. According to AHML employees, the program will be valid until May 31, 2017. Those. It turns out we have 3 months left. and we easily manage to collect the documents. None of the employees ever stipulated that the program could end early; if they had known, they would not have taken the risk and participated in this program. We have already ordered extracts from Rossreestr, which cost 7,400 rubles, and this is not little. By law, the certificates themselves must be prepared within 3-5 days, but in fact, from 1 month, who will be responsible for this? And it is also not possible to revoke the production of extracts, although we do not need them at all. (“Credit and insurance organizations, as well as

short terms.") What kind of injustice and deception of the state is it that you can’t even trust the state? Of course, we were simply unlucky that we were on the list of families who did not have enough money.
I ask you not to ignore the requests of thousands of deceived families!
We kindly ask you to extend the assistance program at least for those families who have already ordered statements! I ask you to take action and not close the program early, find reserve funding so that it will be enough until the end of the program on May 31, 2017.

Why did they close the program, for Russians, as always, there is no money, it is better to help other countries, What a deception people paid the last money for USRN certificates for 4 people 8000 thousand rubles amount for family budget not small, at least the money for certificates would be returned if there is no money to write off interest, we hope that the state will find a positive result in favor of the Russians

And what did you want, scam in the best traditions of our native state. At the end of February they called out: “We’ve thought about you guys, come and let’s sort everything out.” On March 9, I ordered certificates and paid 7,400 (the money was taken out of what was intended for food for the month, now we are finishing up what we had at home, borrowed for bread), on March 9 I learned about the termination of the program, but did not have time to return the money. In total, 3 more people in our department, from March 1-7, ordered such certificates, one of them is a single mother, everyone got into debt, and the result... In general, our state is once again trying to pull the last of our pants off...

Isn’t it confusing that the tariffs for certificates in Rosreestr have almost doubled compared to last year? The money supposedly remained, they decided to extend the program and increased the percentage from 10 to 20 so that more people would take the bait? I think our government doesn’t really care who takes money out of their pockets.
I understand the plight of everyone who has been deceived by this “help program.” We all had hope that at least some of our financial difficulties might finally be resolved... In the end, we were robbed.

Our state will help Syria better. On March 1, we went to the bank with a package of documents, wrote applications, they told us to go ahead, make statements and bring them to hand over the documents. On the 7th in the morning we went to the bank, a bank employee came out and said that the state had run out of money and there would be no payments. I don’t know how they managed to pay out so much money, people stood in line for three months without results, bank employees, their families and friends, that’s just who was able to receive these payments. It's a shame that a hundred and many people paid a lot of money with no results

We found out about this program at the end of February, immediately started collecting documents, borrowed money to order statements for 5 people. Today we went to the bank and they told us that they had suspended the program and would no longer accept applications, I even burst into tears, I was very upset , we were hoping for some kind of help from the state, I’m on maternity leave, I have three children. It’s very disappointing. We really ask you to extend the program.

Ilona's link doesn't work. WE NEED TO GO TO COURT!!! I got into debt because of this program. After February 23, we learned about the extension of the program. On March 4, we picked up the statements and had to re-order a copy of the work report since the deadline was 1 month and the statements were made for 1 month. We call the bank, they say that documents are accepted until April 15, and the program itself until May 31. We calmed down and on March 6 or 7 the program ended. At least the money was returned for all expenses.

Strange, it opens for me. To sue the state is a waste of paying a lawyer. There is a group on VKontakte, I’ll post the link below. In the meantime, I quote Sergei Ignatiev, he writes very competently and

Today we will talk about what the mortgage borrower assistance program is and how exactly you can get help paying off your mortgage
from the state in 2019.

Program for assistance to mortgage borrowers in 2019 from the state, changes and additional 730 million.

Today you will learn:

  • What is this program to help certain categories of mortgage borrowers?
  • How to get help paying off a mortgage from the state?
  • Reviews of those who received government assistance in paying off their mortgage.

What you can get

Mortgage has become one of the effective tools for solving the housing problem in Russia. Yes, it has a number of disadvantages and advantages, which we will consider in a separate post of our project, but this is a real opportunity, especially for young families, to purchase housing.

With the onset of another economic crisis, the state had to provide support to mortgage borrowers who found themselves in a difficult financial situation. In April 2015, the corresponding 373 Decree of the Government of the Russian Federation dated April 20, 2015, signed by D.A. Medvedev. The operator for the implementation of this project was JSC Agency for Housing Mortgage Lending.

Initially, this resolution provided for the validity of the assistance program until the end of 2016, but changes and additions were repeatedly made to it.

Today, according to latest changes 373 Government Decrees of November 24, 2016, assistance to mortgage borrowers (mortgage restructuring) valid until March 1, 2017(extended until May 31, 2017 by Decree of the Government of the Russian Federation dated 02/10/2017 No. 172, from 03/07/2017 the acceptance of new applications has been suspended due to the expenditure of funds under the program.

However, in July 2017, an additional 2 billion rubles were allocated from the government fund to resume the program. On August 11, 2017, new conditions for participation in the program to help mortgage borrowers were released - Russian Government Decree No. 961, which you will learn about from this article) and are as follows:

  • The borrower's mortgage obligations to the bank are reduced in the amount of 20% to 30% of the balance (at the discretion of the lender's bank), but not more than RUB 1,500,000.
  • By agreement between the borrower and the bank, you can choose the format of assistance, namely, either use the entire amount of mortgage assistance to pay off the principal debt and thereby reduce the monthly payment, or to reduce the monthly payment by 50% or more for up to 1.5 years.
  • Replacing foreign currency mortgages with ruble ones. Moreover, the mortgage rate cannot be higher than 11.5% per annum. For a ruble mortgage, not higher than the current bank rate, except for cases provided for in the mortgage agreement, in case of violation of insurance rules.
  • Before September 1, a special interdepartmental commission must be created that will be able to increase the maximum payment under the program by 2 times and approve applications for participation if there are deviations from the basic conditions, but not more than in two points.

Example:If a family has a mortgage balance at the time of restructuring of 2 million rubles and, after checking the AHML documents, the creditor bank decided to write off the debt in the amount of 20% of the balance of the principal debt, then with a mortgage of 12% per annum with a remaining term of 10 years, the payment will be reduced from the planned 28,694 rubles. per month up to 22955. Benefit 5739 rubles.

There is an opinion that very often banks refuse to carry out mortgage restructuring, but in fact this procedure is very beneficial for them because losses incurred by the bank (lost interest income) due to early repayment are compensated by the state.

Changes to the mortgage assistance program dated 02/10/2017 suggest that the maximum compensation of 30% of the balance (up to 1.5 million rubles) is compensated by the state only if there are two children in the family or you are disabled (disabled child), and military veterans can also apply actions. With one child you can only claim 20%. Changes dated August 10, 2017 allow the maximum payment to be doubled by decision of a special interdepartmental commission.

Having analyzed the negative reviews about mortgage repayment with the help of the state, our experts came to the conclusion that most often the basis for refusal is inaccurate information provided by the borrower and lack of knowledge of the basic requirements and conditions of state support. Let's talk about them now.

Important point! Acceptance of documents under the Program has been suspended since December 2, 2018 and the program is no longer operational.

Who can receive support from the state

Government Decree No. 373, as amended on November 24, 2016, provides the following list of persons to whom the state can help pay mortgage payments:

  • Citizens of the Russian Federation with 1 or more minor children;
  • Guardians (trustees) of 1 or more minor children;
  • Participants in hostilities;
  • Disabled people or families with disabled children;
  • Citizens with dependent children under 24 years of age who are studying full-time at an educational institution.

Requirements for mortgage housing

To receive assistance from the state, the mortgaged apartment must meet these characteristics:

  • Should not exceed the total area for a one-room apartment - 45 sq.m., for an apartment with two rooms - 65 sq.m. and for three rubles or more - 85 sq.m.
  • Cost of 1 sq.m. the total area of housing exceeds no more than 60% of the average cost of a typical apartment in your region on the date of conclusion of the loan agreement (according to Federal service state statistics).
  • The residential premises must be the only one for the mortgage borrower. In this case, it is allowed to have a total ownership share of no more than 50% of all family members in one other residential premises. The availability of property is counted from 04/30/2015. Those. It will not be possible to quickly rewrite/donate “extra” real estate in order to become a participant.

Important point! The requirement for the total area of mortgage housing and the cost per square meter does not apply to families with 3 or more minor children. If you have more than 50% of the property in another home, then you will be denied the program, but you can transfer it to relatives and then everything will be OK. From August 11, 2017, disputes regarding square meters and deviations under the program must be resolved by a special interdepartmental commission, which will be created in September.

Requirements for mortgage borrowers

  • Russian citizenship
  • Your income is less than twice the cost of living where you live for each person in your household, subtracted from your monthly mortgage payment. The last three complete months are analyzed. In this case, the mortgage payment must increase by at least 30% of the initial payment.

Those. this program Suitable only for foreign currency mortgages and those borrowers with a floating rate. For ordinary mortgage borrowers, it is impossible for the current payment to be 30% higher than the original payment. But when the interdepartmental commission starts working, it will be possible to submit an application there for consideration, because Up to 2 deviations from the conditions are allowed. Deviation for increasing the monthly payment, among other things.

If you have a co-borrower in the mortgage and he has a registered share in the ownership of this apartment, then he is obliged to provide a full package of documents both for himself and for his family members.

Now answer these questions.
If you receive the answer “NO” to one of them, then you will not be able to qualify for participation in the mortgage borrower support program in 2018:

  1. Do you have minor children or are you a guardian (trustee) of such children?
  2. Housing purchased with a mortgage in Russia?
  3. Are all mortgage borrowers citizens of the Russian Federation?
  4. After subtracting the mortgage payment, is the income for each member of your family less than twice the cost of living in your region?
  5. Has your payment increased by 30% from the original schedule?
  6. Is the mortgage issued for the purchase of finished housing or housing under construction?
  7. The total housing area is less than 45 sq.m. for a one-room apartment, 65 sq.m. for two-room apartment and 85 sq.m. for three rubles and above (except for families with 3 or more children).
  8. Cost of 1 sq.m. no more than 60% of the average cost per square meter in a typical apartment in your region?

If all your answers are “Yes,” then you will be able to receive support from the state in paying off mortgage loans.

How to get government support

Now you already know that you can count on support from the state in repaying the mortgage . Now all that remains is to find out how to get it.

First of all, you need to contact the bank where you received your mortgage. Almost all major banks participate in this mortgage assistance program.

The full list can be downloaded from the link.

As a rule, this issue is dealt with by the department for working with overdue debts. You just need to call your bank's contact center and find out where it is located.

The bank will give you a list of documents for state support for mortgages. A sample list is presented below:

  1. An application form with a mandatory indication of the reason for providing you with assistance from the state (decrease in income, layoff, maternity leave, etc.).
  2. Passports, birth certificates of minors of all family members.
  3. Marriage certificate (if the marriage is registered).
  4. Certificate of divorce, change of full name, parents and children, parental agreement on the child’s residence with one of the parents (if required).
  5. A decision of the guardianship authorities or a court decision to establish guardianship (for guardians and trustees).
  6. Combat Veteran Certificate (for veterans).
  7. Documents on disability of the borrower or co-borrower or their children.
  8. Birth certificate for dependent persons under 24 years of age.
  9. Certificate of family composition to confirm the residence of a dependent under 24 years of age with the borrower/co-borrower.
  10. A certificate from an educational institution stating that a child under 24 years of age who is a dependent of the borrower/co-borrower is studying full-time.
  11. Notice from the Pension Fund that a dependent person under 24 years of age does not have independent labor income.
  12. A certified copy of the borrower/co-borrower’s work record.
  13. Official certificate of employment (for military or law enforcement officers).
  14. Certificate of registration of individual entrepreneurs (for individual entrepreneurs).
  15. Order of the Ministry of Justice of Russia on appointment as a notary (for notaries).
  16. Work record book and/or expired employment contract for the unemployed.
  17. Document on registration with the employment service (for unemployed people).
  18. Notification of the pension fund about the status of the personal account of the insured person (for everyone).
  19. Certificate from the Federal Social Insurance Fund of the Russian Federation about income due to temporary disability, benefits and other payments.
  20. Certificate of income in form 2 of personal income tax or in the form of a bank from all family members.
  21. Bank certificate on the total family income (provided by the bank).
  22. Tax returns, patents, etc.
  23. Certificate of pension amount for pensioners.
  24. Loan agreement
  25. Mortgage note (if issued, it is in the bank).
  26. Application from borrowers about the availability of real estate in Russia.
  27. Equity participation agreement (for a mortgage on a new building).
  28. Mortgage collateral valuation agreement.
  29. Technical/cadastral passport for residential premises.
  30. Mortgage payment schedule.

The list is quite impressive and will make you run a little, but it's worth it. The only point that is quite difficult is extracts from the Unified State Register of Real Estate. They cost money. One extract on property rights throughout Russia is 1,500 rubles per person and no one will return it to you if you refuse. Last time there were a lot of complaints about this. As of August 11, 2017, the requirement to have an extract from the Unified State Register has been cancelled. The bank has no right to demand it. AHML independently requests it.

After a complete list of documents is provided to the bank, the responsible employee must send them to AHML for verification. On average, it lasts 30 days, but feedback from participants indicates that it can last up to six months. The bank and AHML request additional documents at their discretion.

When AHML makes a positive decision, the bank will notify you of the date of the meeting. Next, you will need to sign a new payment schedule, a new PSK document, enter into a restructuring agreement (additional agreement to the mortgage agreement), and an agreement to change the terms of the mortgage. Next, you will need to wait from 2 to 4 weeks, when the mortgage will be requested from the bank’s archives. After this, it is necessary, together with complete package loan documents and an agreement to change the terms of the mortgage (be sure to make copies) visit the justice department for state registration of changes.

The process is similar at Gazprombank. VTB 24 closes your mortgage and issues a new loan for a smaller amount, which means that you again have the cost of paying for insurance and appraisal.

There is no charge for mortgage restructuring. Carrying out this procedure does not relieve you from paying the monthly payment and insurance premiums stipulated by the contract.

Conclusion

There are a number of negative and positive feedback under this program.

Positive:

  • A support amount of up to 600,000 rubles can help reduce your mortgage payment.
  • Reducing your mortgage payment can help ease a difficult financial situation.

Negative:

  • Large list of documents.
  • Lack of transparent mechanisms for tracking the stages of application consideration.
  • Long processing times.
  • There is no mandatory requirement to state the reason for refusal.

From this we can conclude that the assistance program is indeed good tool support for mortgage borrowers, but the mechanism for its implementation is complex, clumsy and opaque, which leads to negativity from the population.

I hope now everything is clear to you, how pay off the mortgage with the help of the state.

Important point! If you have submitted an application for participation previously, but have not received a response, then you need to collect all the documents again and submit the application again.

If you were unable to participate in this program, we recommend that you consider another type of support for mortgage borrowers - Detailed conditions described in a special post. Read on.

In October 2018, Dmitry Medvedev signed a government decree to continue the program to help mortgage borrowers. An additional 730,000,000 rubles were allocated for the implementation of this program.
