Penalty for crossing a double solid line. What is the penalty for crossing a solid line? Crossing one solid line is a fine.

Section 9 of the traffic rules regulates in several points at once the situation in which we are prohibited from making a left turn maneuver and ending up in oncoming traffic. The problem is that two articles of the Administrative Code provide for sanctions for this: one for driving in the opposite direction (deprivation of rights), and the second for crossing a continuous line (including a double one). But what if we make a U-turn and turn through a solid road - what fine or deprivation of rights for what period can be provided for this in 2019? The answer to this question is not so simple, but we will figure it out.

From the testimony of the traffic police regiment inspector of the traffic police department of the internal affairs department for the municipal formation “Ekaterinburg city” I. given to the magistrate, it follows that the car was driven by M.V. Markin. began a turn, crossing the solid marking line. According to the existing scheme, it is not clear that Markov M.V. driving a car in oncoming traffic...

In connection with the above, the judge comes to the conclusion that the totality of the evidence provided indicates that the actions of M.V. Markin did not constitute an administrative offense under Part 4 of Article 12.15 of the Code.

The actions of the latter constitute an administrative offense under Art. 12.16 of the Code, that is, failure to comply with the requirements prescribed by the markings of the roadway.

Thus, according to the law, for turning left or making a U-turn through double and single continuous lines in 2019, a punishment is provided under Part 2 of Art. 12.16 Code of Administrative Offenses - a fine of one thousand to one and a half thousand rubles.

The only problem is that not all traffic police officers think the same way and stubbornly impose a deprivation clause for such maneuvers. Moreover, even some cameras that automatically record violations impose a fine of 5,000 rubles (deprivation of rights under the camera is not allowed by law) for them.

However, district judges, as a rule, are unambiguous in their attitude to such a violation as turning left or turning across a double solid line - a fine for this is imposed according to 12.16 in the amount of 1,000-1,500 rubles.

Is it possible to cancel the penalty for turning and turning across a solid road?

The answer to this question is yes. And there are even two “good reasons” for canceling the fine.

Insignificance

One of these is the insignificance of the offense, provided for in Article 2.9 of the Code of Administrative Offences. Its essence lies in the fact that the judge or traffic police officer considering the case can cancel the punishment under the article corresponding to such a violation, and only give you an oral reprimand.

The bad news is that, due to insignificance, the punishment is canceled in very rare cases, and the composition and event of the violation should not have the following aggravating circumstances (Article 4.3 of the Administrative Code):

  • continuation of the violation despite demands to stop it,
  • repeat violation U-turn or left turn through solid (),
  • committing a violation against the backdrop of natural disasters or emergencies.

Accordingly, the maximum number of mitigating circumstances must be present (Article 4.2 of the Administrative Code):

  • offender's remorse
  • "turning yourself in"
  • assistance in determining the circumstances of the violation,
  • no harmful effects,
  • violation in a state of strong excitement or under difficult circumstances,
  • the age of the offender is under 18 years,
  • if the offender is a pregnant woman or has young children.

But even if you have all these mitigating circumstances and no aggravating ones, you still shouldn’t expect the decision to turn left or turn across a continuous line to be canceled, since it is not always applied in 2019.

Urgent necessity

Another reason for canceling a decision is a state of extreme necessity (Article 2.7 of the Administrative Code). Its essence lies in the fact that you made a U-turn or a left turn through a double or single continuous lane in order to, in conditions of danger, for example, to prevent an accident or your passenger became ill, and there is simply nowhere to stop on the right.

But a state of extreme necessity has an indispensable condition: the harm caused by such a U-turn or a turn crossing a prohibited marking must be less significant than the harm prevented. How you will prove this, especially the harm prevented, is up to you, and it is not easy. However, this basis is much more probable than insignificance... In the presence of objective extreme necessity, of course.

Good afternoon, Maxim. I try not to miss your releases and study them carefully. Very useful and extremely necessary information. And let me ask a question: what should I do if there is a fine for a violation that I did not commit and could not even physically be in the area. When checking by the resolution number (issued to me) the fine has been paid and when checking by license number and the car hangs, but with a different decree number. It seems that my data was entered into someone else’s protocol intentionally (I don’t want to believe it) or they made a mistake when entering it into the database, which is also somehow hard to believe.

Hello Maxim. What I don’t understand in your article is where the traffic rules say that when leaving the yard, you can cross solid marking lines, especially when entering the lane of oncoming traffic when turning left. Please indicate this is a traffic rules clause. Best regards, Boris.

Magomed-3

Good afternoon, Maxim. I have the following question. Do traffic police officers have the right to take photographs from a moving private car and then attach it to the protocol on administrative violation. And then, without familiarizing themselves with the material, send it to the court. Thank you in advance.

Good luck on the roads!

Boris, Hello.

Continuous markings (single 1.1 and double 1.3) separating traffic flows in opposite directions cannot be crossed.

Lines 1.1, 1.2.1 and 1.3 are prohibited from crossing.

In any case, the driver will receive a fine for crossing these types of markings. This article is about fines.

Good luck on the roads!

Magomed, Hello.

If we are talking about a specific traffic situation, I recommend consulting with a competent lawyer. Most likely, he will find violations after studying all the materials in the case.

Good luck on the roads!

Maxim, I don't understand why a 90% degree turn qualifies as something like through passage through the oncoming lane, but not as entering the oncoming lane, but moving along an oblique trajectory as a clear exit into oncoming traffic. It seems to me that not everything should be so simple. Can you make an argument in terms of traffic regulations?

Igor, the lane is an oncoming lane only if the traffic on it is towards your car. If you drive along the road at a right angle, then the lanes are perpendicular. Those. none of the lanes are oncoming traffic.

In general, you don’t need to cross solid marking lines, then there won’t be any problems.

Good luck on the roads!

Tatyana-58

I had a slightly different situation. I turned left at the intersection and was a little short of the intermittent markings, but I didn’t go to the continuous markings because... turned onto a one-way road. The traffic cops threatened me with imprisonment for six months, but then they released me. What really threatened me? What are the fines?

Tatiana, the car ended up driving along continuous markings or along intermittent ones?

Tatyana-58

Sorry, I misspoke. I didn’t go to the meeting. It turns out that the continuous one was crossed a meter from the intermittent one.

Tatiana, if you crossed solid markings within the intersection of roadways, then the punishment could range from 1,000 to 1,500 rubles (part 2 of article 12.16 of the Administrative Code).

If the markings were crossed outside the intersection of roadways, then the driver could be punished under Part 4 of Article 12.15 of the Code of Administrative Offenses (5,000 rubles or deprivation of rights for 4-6 months).

Good luck on the roads!

Svetlana-53

Good afternoon My son is a citizen of Russia, has a residence permit in the Republic of Belarus, in connection with this he received a license in the Republic of Belarus, in at the moment he lives in Moscow. Recently an incident happened to him: he turned around in 2nd solid line, he was immediately stopped by traffic cops, they said that he would be deprived of his rights, the question is: can Belarusian rights be deprived in the Russian Federation??? PS: in the end they took 20 thousand from him into their pocket!!!

Svetlana, Hello.

On the territory of the Russian Federation, they may, among other things, deprive a driver’s license issued in another state. In this case, to get your license back, you will also have to pass an exam on Russian traffic rules.

Good luck on the roads!

Wowochka If the markings are not visible, then you should not be punished for crossing them. However, the remaining requirements of the rules must be observed.

Good luck on the roads!

Good afternoon I was leaving the yard turning left, marking 6.1 (intermittent, turning into solid before the traffic light). Traffic police officers stopped me, drew a diagram that I drove in the oncoming direction and turned at the crossing, and I turned at a right angle or maybe a slightly skewed angle. I didn’t sign the protocol and the diagram; I received a subpoena. They press in Article 12.15 Part 4. Is this legal? How should I behave in court?

If you can’t come up with anything, then go to court, where you will repent of the offense you committed. This will be a mitigating circumstance and the deprivation of rights will be replaced by a fine.

Good luck on the roads!

I am alarmed by this definition - a competent lawyer. In fact, from my small judicial practice, concluded that he is either someone who comes to the judge unofficially to “resolve the issue,” or an ordinary illiterate swindler extorting money for his “services” (he is of no use). This “literate” guy - does he know any other traffic regulations or something? Maxim will answer that he (the lawyer) has more experience in courts, etc. Anna, I recommend that you google (I prefer Yandex) your question and select required material. I assure you that after this no lawyer will be more competent than you on this issue.

GDW nik, in this case, you need to study all available materials (documents, diagrams) and understand what the author of the question (Anna) has already done correctly/wrongly. In the event of the same violation, a driver may behave differently, and the court’s decision depends on this. Therefore, it is easier (faster) to resolve the issue by contacting a lawyer in person than through a forum to “pull out” intermediate data over the course of several weeks.

Good luck on the roads!

Alexander-362

Dear Maxim!

Today I caused an accident due to carelessness (I was in a hurry).

Turned with local area to the left through a double solid line, so that you can then immediately turn right into the garages, that is, the adjacent roads on both sides of the main one are offset from each other along the axis by about five meters. There were no cars for about 300 meters on the left. But on the other side of the traffic, a minibus passed in the second lane, but I didn’t notice it walking in the first lane because I was looking at the entrance to the garage. I crossed almost a double lane at a right angle, because there were also 2 lanes on the other side of the road. Thus, a Nissan crashed into my right door in the first lane. The traffic police “sew” an oncoming lane for me, showing the exit trajectory on the accident diagram and the adjacent part at an angle towards the movement. I refused to sign such a protocol, saying that I was to blame for the inattention-accident and that I drove straight ahead in violation of the rules under Article 12.16 - for failure to comply with the requirements prescribed road signs or markings. In general, the case was transferred to the investigator on March 31, and the traffic cops tell me that I drove into oncoming traffic, ALTHOUGH no one saw this, they cannot say. Even the victim, who if he had observed me crossing the road from the other side, would have had time to take action. How can you comment and what would you advise me?

Alexander, Your interpretation in this case is correct. You were not driving in the oncoming lane. Insist on this to the end, if necessary, challenge the possible punishment in higher authorities (court).

Good luck on the roads!

Every line road markings on highways and in cities obliges drivers to comply with specific requirements to ensure that all road users are safe. Administrative liability cannot be avoided if you decide to ignore traffic rules and cross a solid road. What fine does a driver face for crossing a solid road, depending on the type of violation, and can it be avoided?

There are several types of solid lines on road markings.

  1. Single is designed to divide the roadway into two parts, where movement occurs in opposite directions. Apply using yellow or white paint.
  2. The double serves the same purpose, but there will be multiple lanes in each direction on the right and left sides. White or yellow paint is also used to apply it.
  3. Temporary solid paint is applied in orange while the road surface is being repaired.
  4. Permanent is applied in yellow or white.

Penalty for crossing a solid line will follow regardless of its type. Such lines are drawn both within the city and outside its boundaries to prohibit crossing or overtaking other vehicles.

Types of violations and corresponding fines

So, what fine for crossing a solid line does the Code of Administrative Offenses provide, depending on the type of violation? Let's look at them.

  1. Turning or turning across a solid road is punishable by a fine of 1,500 rubles. The penalty for turning through a double solid line is issued more often than others (read also about).
  2. Driving into oncoming traffic will result in a fine of 5 thousand rubles. or deprivation of a driver's license for a period of 4 - 6 months. There can be several problematic situations, for example, the driver decided to drive into oncoming traffic tram tracks, the oncoming lane after a turn or cross a solid lane to overtake another vehicle.
  3. Avoiding an obstacle while turning around through a continuous road is punishable by a fine of 1 - 1.5 thousand rubles. An obstacle may be a stalled car ahead or a fallen tree.
  4. Leaving the yard by turning left and crossing continuous marking will lead to a fine of 500 rubles. Previously, for such a violation, the driver was deprived of his license. It is worth noting that turning according to the rules traffic should go right.
  5. Making changes at an intersection with a solid intersection leads to a fine of up to 1,500 rubles (read also about). Administrative punishment in this case is provided not only for crossing a continuous road, but also for performing a maneuver at an intersection, which is prohibited.
  6. Crossing a solid line when overtaking, even if the maneuver began with a broken line, is punishable by deprivation of rights or a fine of 5 thousand rubles. (read also about punishment for).
  7. Changing to the second row while crossing a continuous line results in a fine of 1,500 rubles.
  8. Hitting a solid road, even if there was no crossing, is also regarded as a violation. The number of wheels driven over does not matter. Fine – 5 thousand rubles. or deprivation of rights for 4 - 6 months. The choice of punishment by traffic police officers depends on the seriousness of the violation. If you refer to Part 1 of Art. 12.15 of the Administrative Code, you can get by with a fine of 1,500 rubles, but the driver must have irrefutable evidence of the fact of a collision, and not an intersection.

Even more useful information, which concerns when it is appointed, you will find in the material of our expert.

Read additionally a very interesting and useful article by our specialist, in which he talks about.

Automatic fixation of the intersection of solid

The intersection of a solid marking line is recorded automatically by photo and video cameras. The practice of using these means to monitor compliance with traffic rules on the road was introduced in 2008. We are talking about the following types of fixation.

  1. Traffic police inspectors use mobile systems.
  2. Radars with video recording function, for example, “Vizir”.
  3. Stationary cameras that transmit collected information to centers where the data is processed. Next, materials sent to drivers (notification letters about the need to pay a fine) are generated.

New models are developed and put into practice on an ongoing basis. The most modern models are designed to record violations at night, and are also additionally capable of monitoring barriers and traffic lights remotely.

Among the key shortcomings of the technical devices currently used for recording violations, it is worth highlighting the inability to clearly record license plates in conditions of poor visibility or in the dark. False positives often occur.

How to avoid administrative punishment

A driver who has been issued a fine for crossing a solid marking line has every right to appeal the punishment in court or through the leadership of the local traffic police, based on the following circumstances.

  1. Fuzzy markings. The fact must be confirmed with photographs, preferably with a link between your car and the transport of traffic police officers.
  2. Incorrect markup. A continuous solid line does not begin immediately after a broken line; there should be a section of a broken line between them, but with shorter intervals and long strokes so that the driver has time to orient himself. If there is no such crossing, the road is not marked according to GOST, and the driver has the opportunity to challenge the punishment by providing a photo or video as confirmation.
  3. Forced crossing of a continuous road when absolutely necessary, for example, to prevent an accident.
  4. Another driver being behind the wheel. This fact will need to be documented (your absence from the city or country at the time of the offense, presence of a power of attorney to manage vehicle another person). If you can prove that you were not driving at the time the offense was committed, the responsibility to pay the fine will fall on the driver who broke the law.
  5. Incorrect identification of the number is a common sin of automatic recording tools, and to confirm the error it is enough to simply provide your own numbers.

If a violation on your part was recorded not by automatic recording means, but by a traffic police inspector, you have the right to demand filming of what happened. Pay attention to the sealing of the device, the date of inspection, calibration, and license. Any violations may save you from having to pay a fine or lose your driver's license. It has long been impossible to film with household video cameras; video recording devices must be specially prepared and approved for use. If you have doubts about this fact, then you have every chance to challenge the punishment.

Remember that success in court is only possible if the driver has evidence of his own innocence in the form of photos or videos.

Punishment for failure to pay a fine

The types of penalties that apply for refusal to pay a fine are listed on the official website of the traffic police.

It is worth preparing for several scenarios:

  • imprisonment for 15 days;
  • a twofold increase in the previously imposed fine;
  • 50 hours of corrective labor for the benefit of the state.

To summarize, it is worth paying attention to the possible size of the fine, which can vary between 500 - 5000 rubles. depending on the nature of the violation and the associated risks that road users were burdened with. It is also possible to be deprived of the right to drive a car for up to 6 months.

A double solid line is used on roads that have 4 or more lanes. The main purpose of this line is to delimit the movement of cars moving in opposite directions. In general cases, crossing this type of line is prohibited, and violation is subject to a fine. Specific situations in which there is a risk of being fined, as well as options for preventing punishment, will be discussed below.

Penalty for crossing a double solid line

Every year, crossing a double solid line is one of the most popular violations for which drivers are fined. Situations in which this violation may occur are when the line is crossed:

  • when leaving private or adjacent territory (yard, gas station, parking lot);
  • while driving on a two-way road;
  • when crossing a controlled intersection;
  • during a wrong turn.

Depending on the specific type of violation, the following punishment may be applied to the driver:

  1. Driving around an insurmountable obstacle without complying with the rules (that is, crossing the line) is punishable a fine of 1000 to 1500 rubles. (in accordance with Article 12.15 of the Code of Administrative Offenses of the Russian Federation). A car that has had an accident or stalled can be considered an insurmountable obstacle.
  2. A U-turn or a left turn in violation of the marking rules also implies fine from 1000 to 1500 rubles., but in accordance with Art. 12.16 Code of Administrative Offenses of the Russian Federation.
  3. Driving into the oncoming lane while crossing a double solid line can result in both a fine and deprivation of your license. In the first case, the amount will be 5000 rubles., in the second driver's license can be taken away for a period of 4 to 6 months. These measures are established by Art. 12.15 of the Code of Administrative Offenses of the Russian Federation. Deprivation of rights can only be applied in the case of overtaking a vehicle and entering the opposite lane. If such a violation is repeated (that is, within one year after the first time), the punishment for the driver will be more serious. He could be deprived of his license for a period of one year.

A violation can be detected in two ways:

  1. Traffic police officer. Such a violation is recorded by the inspector in the protocol after stopping the car. A receipt for the fine can be issued to him there and then.
  2. Technical means of photo and video recording. In this case, the driver may not even know about the recorded violation - a notice of this, along with a receipt for payment of the fine, will be sent to him by mail.

IMPORTANT! In the latter case, the maximum punishment cannot be applied to the violator, that is, they cannot deprive him of his rights.

The driver can challenge the penalty within 10 days after its application. This can be done only on the condition that he can prove the legality of crossing the double line.

When is crossing the line allowed?

In some cases, the driver will be able to avoid possible penalties for crossing a double solid line if he can prove that his actions were caused by extreme necessity. Such situations include:

  1. Prevention of road accidents, causing damage to the life and health of pedestrians or passengers. If the driver can prove that following the rules could cause harm to people, violating them will not be punished. However, if the final damage resulting from crossing the line exceeds the possible consequences, then punishment will still follow.
  2. Avoid the obstacle if there were no other options. For example, if the road part was occupied motionless standing car, you can go around it on the left, thereby breaking the rules.

IMPORTANT! This is only allowed if there is no way to pass on the right. If the driver was simply too lazy to pass on the right and chose to cross the prohibited line, he will also be fined.

Before making a detour, you need to let all oncoming cars pass and make sure that this maneuver is safe. It should be noted that a traffic jam or a car stopped according to the rules are not considered obstacles, therefore, if you go around them and enter the oncoming lane, the driver will also be punished.

Each of these cases will need to be proven. For example, this may require eyewitness testimony or materials from photographic or video equipment. In addition, entering the oncoming lane is allowed to make a U-turn, but only if the following signs are present:

  1. Sign 6.3.1. allows left turns in the place where it is installed.
  2. Sign 6.3.2. allows you to turn around over a certain section of the road indicated on it (for example, 10 or 15 m).

IMPORTANT! In both cases, you are allowed to turn left, but not turn.

The requirements of the signs are a priority in the Traffic Rules, therefore crossing a double solid line if they are present is allowed. Another way to avoid punishment is to refer to the poor quality of road markings - if the line is really blurry and poorly visible, the driver will be able to avoid a fine. It is advisable to confirm this statement with photographs or videos taken in the presence of a traffic police inspector. In most cases, you will have to prove your innocence in court.

A huge number of cars aggravates the difficult situation on the roads, which leads to frequent violations drivers of traffic rules. Despite the tightening of responsibility, cases of crossing a solid road have become especially frequent; the fine for such non-compliance with the rules is growing from year to year, and ranges from 1000-5000 rubles. What fine a driver will be given for crossing a solid line in 2018 directly depends on the method of committing the offense.

Double and single solid

If the road has 2 lanes, a single continuous marking is applied to the road surface, which separates oncoming traffic flows. A similar task is performed by double continuous markings; its presence means that the road is intended for traffic of 4 lanes or more. Therefore, crossing double or single solid markings actually means that the vehicle has entered the oncoming lane, exceptions include parking lots that are continuous for markings.

Why was the law softened?

The condition of the road surface and, often, thoughtless traffic management sometimes force drivers to deviate from traffic rules. Potholes, hatches, potholes, which are wiser and safer to go around, breaking the rules, continuous markings, contrary to all logic, for many kilometers, hence the inability to turn around, or a “turtle move” behind a tractor - all these circumstances lead to the occurrence controversial issues. Therefore, in the amended Code of Administrative Violations, more lenient articles appeared for vehicles crossing a solid line. In connection with the new rules, the Road Traffic Safety Department explained which articles are applicable in different situations when a car passes through a continuous median, how to qualify a violation, and what fine should be imposed.

Violations and penalties

Previously, according to the Court, any maneuver that led to a vehicle wheel crossing a solid line was considered a vehicle entering the oncoming lane. After relaxations in the Law, the situation has changed dramatically; now it is clearly regulated what will result in the deprivation of a driver’s license, and what crossing of a double or single continuous line is punishable by a fine.

Penalty for crossing a solid line when overtaking

According to statistics, overtaking involving crossing a solid dividing line is the most common violation on the roads. IN article of the Code of Administrative Offenses 12.15 provides for the driver's responsibility. When overtaking and at the same time crossing a solid marking line, the 2018 fine is clearly stated in Part 4 of this article: the maneuver is punishable by deprivation of a driver’s license for a period of 4-6 months. No reasons will save you, even if you explain your actions by overtaking a barely crawling tractor.

The driver of a slow-moving vehicle will be held accountable for failing to move out of the lane onto the side of the road, interfering, and not letting cars pass, but this will not save you from being punished for an offense.

Overtaking, crossing a solid dividing line during a maneuver and, as a result, driving into oncoming traffic, is punishable by law by deprivation of the driver’s license for six months

Haste when turning

If it is necessary to turn left, drivers are often in a hurry and do not reach the intermittent markings in a hurry; this violation and responsibility for it is also determined by Article 12.15, paragraph 4. Drivers have a simple excuse, there is nothing left, just think, I will cross the road a meter or two early, and enter the continuous line. Such a maneuver is regarded by law as driving into the oncoming lane and creating a dangerous situation on the road; for this violation the driver is punishable by deprivation of his license.

There is also a more lenient punishment for crossing the dividing solid markings. Next, we will look at cases for which violations of drivers’ rights are not deprived, but can get off with a fine.

For a premature left turn with a collision with a solid road, the driver will have to say goodbye to his license

Avoiding stopped vehicles

There are often cases when a parked car blocks the road. According to the rules, you can go around this obstacle on the right. If this is simply not possible, drivers are allowed to go around the standing obstacle on the left, crossing the solid dividing line. When performing a maneuver, you should give way to traffic moving towards you. Under these circumstances, the inspector should not regard crossing a continuous line as a violation.

But, if the driver had the opportunity to go around a standing car on the right, but he wanted to go around it on the left because it seemed easier to him, then Part 3 of Article 12.15 comes into force, which states that the violation is regarded as a vehicle entering the oncoming lane due to a detour obstacles, for which the driver is entitled to a fine of 1,000 to 1,500 rubles.

When driving around a stationary vehicle and having to cross a solid marking line, a fine in 2018 will be charged in the amount of 1000-1500 rubles

U-turn through a continuous line

Drivers believe that turning around across a solid dividing line will result in immediate deprivation of their license; traffic inspectors support this misconception. Here we should turn to the new Law, which states that if the driver hit a solid road and drove into the lane of oncoming traffic for the purpose of turning around, then the violation is qualified by part 3 of Article 12.15, liability here does not include deprivation of the driver’s license, but a fine in the amount of 1000- 1500 rubles.

The penalty for crossing a solid line when making a U-turn in 2018 is a fine of up to 1,500 rubles

Turning left across a solid dividing line is equivalent to crossing a solid marking, and even with vehicles entering the oncoming lane. Part 3 of Article 12.15 comes into force here, for this violation According to the Law, you will be fined 1000-1500 rubles.

If a solid road is crossed when leaving the yard

Often the road is painted solid, but the driver needs to get out of an alley or out of a yard. According to the rules, a left turn in this case is a gross violation, but your license will not be taken away for this maneuver either. In this case, Article 12.16 on violations of the requirements prescribed by markings and signs comes into force, and for such crossing of a solid marking line the fine in 2018 is only 100 rubles.

When leaving an alley or from a yard and crossing the maneuver, the fine in 2018 is 100 rubles
