The logical continuation of this work was the fact that since the end of 2016, automatic complexes began to be actively introduced on the roads of the country, fixing violations related to the failure to provide an advantage to a pedestrian at a pedestrian crossing. And the fine for violations by drivers in 2017-2018 increased to 2,500 rubles. So, what should the driver and pedestrian know.

What should a driver do when passing a pedestrian crossing

According to the traffic rules of the Russian Federation, a car driver is obliged to give way to pedestrians crossing the road or stepping on carriageway (tram rails) to make the transition. If vehicles are stopped or slowed down just before the crossing, other vehicles moving in the same direction must also stop or slow down. In addition, the driver is prohibited from entering a pedestrian crossing if a traffic jam has formed behind it, which will force the driver to stop at the pedestrian crossing.

What are the duties of a pedestrian

At unregulated pedestrian crossings, pedestrians can enter the carriageway (tram tracks) after they estimate the distance to approaching pedestrians. Despite the fact that duties and rules must be observed by all participants traffic, traffic police officers, as a rule, take the side of the pedestrian in a dispute between a pedestrian and a driver. And in 90% of cases, it is the driver of the car who is guilty of violating the rules.

Automatic cameras do not resolve this dispute, but only exacerbate the problem, since the algorithm of their work is not perfect, and their use is becoming more popular.

How the camera captures a violation at a pedestrian crossing

The camera is installed after an unregulated pedestrian crossing and captures cars passing through this crossing.

After the pedestrian starts moving along the crossing to the opposite side of the carriageway, the camera records the speed of the car approaching the crossing.

If the driver, taking into account his speed of movement, does not have the technical ability to stop in front of a pedestrian crossing, then a fine is not issued. If the driver had the opportunity to stop the vehicle, but did not give way to a pedestrian and drove along a zebra, an administrative penalty is imposed.

Hence the disadvantages: it turns out that the camera cannot detect real violations in cases where the car travels at high speed, does not have time to stop before the transition and interferes with pedestrians. At the same time, they are often written out when the pedestrian has not yet reached the lane along which the car is moving, the driver did not interfere in any way with crossing the road and drove through the crossing.

Meanwhile, the Supreme Court of the Russian Federation ruled (), where it indicated that if the trajectory of the movement of a car and a pedestrian intersect and the driver did not give way to the pedestrian, there is a violation, if they do not intersect, there is no violation.

The amount of the fine for not providing the advantage to a pedestrian

When driving through pedestrian crossings, the driver must be guided by the following paragraphs of the Rules of the Road:

14.1. The driver of a vehicle approaching an unregulated pedestrian crossing must give way to pedestrians crossing the road or entering the carriageway (tram tracks) to make the crossing.

14.2. If a vehicle stops or slows down before an unregulated pedestrian crossing, the drivers of other vehicles moving in the same direction are also required to stop or slow down. It is allowed to continue driving subject to the requirements of paragraph 14.1 of the Rules.

The term "give way" is understood as a requirement that a road user must not start, resume or continue to move, to carry out any maneuver, if this may force other road users who have an advantage over him to change direction or speed .

In 2018, for violation of these rules, an administrative fine is provided in the amount of 1,500 to 2,500 rubles (Article 12.18 of the Code of Administrative Offenses of the Russian Federation).

At the same time, it must be remembered that a pedestrian or cyclist crossing the road should not run out or go to the crossing:

  • at unregulated pedestrian crossings, pedestrians can enter the carriageway (tram tracks) after they estimate the distance to approaching vehicles, their speed and make sure that the crossing will be safe for them.

After fixing the violation, the video device automatically transmits the captured frames to the central server, where the data of the owner of the car by its number and brand are entered through the traffic police database.

Further, a letter with a protocol and a Resolution on an administrative fine is sent by mail to the owner of the car, which must be certified by the seal of the CAFAP or the traffic police. Photos of the recorded violation must be attached to the letter.

The photo must show the license plate of the car, fixed in front or behind. Letters are sent with acknowledgment of receipt.

Note! The date of notification serves as the beginning of the two-month period allotted for the payment of the fine. It can be paid at any branch of the bank using the details specified in the Resolution on violation of traffic rules.

What to do if you received the Resolution, but do not agree with it? There is no point in ignoring paper. Sooner or later the fine will have to be paid. But the Resolution can be appealed within the first 10 days from the date of its receipt.

In the event of receiving an unreasonable Resolution on violation and a fine, the driver must himself prove the absence of his guilt. The presumption of innocence does not apply in this situation (Article 1.5 of the Code of Administrative Offenses of the Russian Federation).

You can, for example, file a complaint through the official website of the traffic police, as did the motorist from Moscow, mentioned in the above example. In his case, the Decree imposing a fine was set aside.

The Decree is also appealed through the State Traffic Inspectorate or through the court. But, as practice shows, it is much more convenient to file a complaint through the traffic police website.

What fines issued on the basis of a camera picture can be appealed? Here are the most common situations:

  1. The number of your car and the registration plate in the photo are different.
  2. The license plates in the picture are unreadable.
  3. For a violation recorded by one camera, you receive several receipts for the payment of a fine.
  4. There was another driver behind the wheel at the time of fixing.
  5. The speed of the car recorded by the camera exceeds the capabilities of the car itself.
  6. There is no prohibition sign or its effect has ended before the place where the camera recorded the car. Typically, such fines are issued for illegal parking, while there is no sign on the road section prohibiting parking.

What is a violation at a pedestrian crossing

How the camera sees the situation at the crossing

The TsODD explains that the simultaneous presence of a pedestrian on a zebra and a car in the control zone is considered a violation, but the mere presence of two objects in the camera's field of view is not enough. The camera independently calculates the trajectory of the movement of a pedestrian and a vehicle, as well as the possibility of their intersection at one point in time. “The video fixation complex can determine the change in the pace of the movement of the pedestrian, the cessation of his movement, the change in the direction of movement,” the TsODD said. In addition to the photographs that are sent to the violator along with the decision, the department keeps a video of the moment of the violation. At which crossings are cameras hung?

Cameras are hung only at equipped crossings with high-quality zebra crossings, a complete set of road signs and a lighting system. The number of rows of control is not limited, but in Moscow the Fast and the Furious cameras work for no more than three. Crossings over wider streets are equipped with traffic lights, the TsODD says: “Currently, three lanes in one direction is the most used solution precisely because of expediency, since traffic light regulation is organized with a larger number of lanes.”

Can a pedestrian set up a motorist

If the car is already driving along a zebra, and the pedestrian is standing at the edge of the road and suddenly decides to go to the crossing, it is impossible to impute a violation to the motorist, they say in the TsODD: walks along the sidewalk in the direction of the pedestrian crossing, no sign of violation is formed.

What is the penalty for not allowing a pedestrian to pass at a crosswalk?

Initially, the fine for motorists for not providing an advantage to pedestrians was 1,500 rubles, but at the end of 2017, Vladimir Putin signed a law to toughen the punishment. The fine increased to 2500 rubles. Officials explained the need for toughening by the increase in the number of accidents at crossings and the high risk of such violations. At the same time, the issue of a mirror tightening of liability for traffic violations for pedestrians was discussed, but the fines remained the same: 500 rubles. or 1000–1500 rubles if the violation was committed in a state of intoxication, as well as when obstructing the movement of vehicles or causing harm to the health of the victims. That is, if an accident with victims occurred through the fault of a pedestrian, he will be fined 1,500 rubles.

Placement of video cameras and control zones

Video cameras are placed on a bearing support installed on the side of the road at a distance of 15-40 meters from an unregulated pedestrian crossing. I try to avoid this road and only drive there at night when the traffic is lighter. Fortunately, there are other routes.

Perhaps a camera will soon be installed in this place, it is very lively. After all, fines are now also coming to drivers who did not let pedestrians through at an unregulated crossing. There is also clause 14.2 of the SDA:

If a vehicle stops or slows down before an unregulated pedestrian crossing, the drivers of other vehicles moving in the same direction are also required to stop or slow down. It is allowed to continue driving subject to the requirements of paragraph 14.1 of the Rules.

But liability for violation of paragraph 14.2 is not provided.

In practice, some strange algorithm is described, according to which a driver receives a fine if he could stop before the transition, but did not. And if the speed did not allow to slow down, then the driver is not to blame. Those. no "racer" will be fined. The same photos again, for clarity. This time, it is not the pictures that matter, but the caption under them.

Of course, pedestrians must be allowed to pass at the crossing. Drivers who don't do this should be punished. But I would like this to be done initially according to the law and there would be no questions about the operation of video recording systems and their algorithms.
